The purchaser is a consumer, i.e. a natural person who, when concluding and performing a consumer contract, is not acting within the scope of their business, employment or profession. Purchases made by a business entity are governed by the Commercial Code No. 513/1991 Coll. The supervisory authority for consumer protection is the SOI Inspectorate for the Žilina Region, Predmestská 71, P.O. Box B-89; 011 79 Žilina 1.
Order and conclusion of the contract
The submission of a completed order by the buyer is deemed to be a proposal to conclude a contract in accordance with the Civil Code, based on the seller’s offer in the online shop. The contract is concluded upon confirmation of the order by the seller.
Prices of goods
All product prices in the online shop are final, including all taxes. The seller is a VAT-registered business. The product price does not include delivery costs. These are listed on the ‘Delivery’ page and in the shopping basket before the order is finalised, where the buyer can also see the total price of the order, including delivery costs.
Payment for goods
The seller accepts payment for the ordered goods via the methods listed on the ‘Payment’ page. Placing an order via the online shop constitutes the buyer’s obligation to pay the seller the price for the ordered goods.
Delivery of goods
If no delivery time is specified for a product, the seller will inform the buyer by telephone of the estimated delivery date. Goods for which no delivery time is specified are usually delivered by the seller within 30 days.
The goods are deemed to have been accepted at the moment when the buyer or a third party designated by the buyer (excluding the carrier) takes delivery of all parts of the ordered goods, or if: a) goods ordered by the buyer in a single order are delivered separately, at the moment of acceptance of the goods delivered last; b) where goods consisting of several parts or items are delivered, at the moment of acceptance of the last part or the last item; c) the goods are delivered repeatedly over a specified period, at the moment of taking delivery of the first goods delivered.
Return of goods – withdrawal from the contract without giving a reason
The buyer is entitled to withdraw from the contract without giving any reason within 14 days of the date of taking delivery of the goods. Only a consumer may exercise this right. The buyer may withdraw from a contract for the supply of goods even before the withdrawal period begins.
The buyer may not withdraw from a contract the subject of which is:
- the provision of a service, if the provision of the service has commenced with the consumer’s express consent and the consumer has declared that they have been duly informed that, by giving this consent, they lose the right to withdraw from the contract once the service has been fully provided, and where the service has been fully provided,
- the sale of goods or the provision of a service where the price depends on fluctuations in the financial market over which the seller has no control and which may occur during the withdrawal period,
- the sale of goods made to the consumer’s specific requirements, custom-made goods or goods intended specifically for a single consumer,
- the sale of goods liable to deteriorate or expire rapidly,
- the sale of goods sealed in protective packaging which cannot be returned for health or hygiene reasons and where the protective packaging has been broken after delivery,
- the sale of goods which, by their nature, are likely to be inseparably mixed with other goods after delivery,
- the performance of urgent repairs or maintenance which the consumer has expressly requested from the seller; this does not apply to service contracts or contracts for the sale of goods other than spare parts necessary for the performance of repairs or maintenance, if they were concluded during a visit by the seller to the consumer and the consumer did not order these services or goods in advance.
The buyer may exercise the right to withdraw from the contract in writing or on another durable medium (e.g. by email), or by sending a completed form. The right to withdraw from the contract may be exercised by sending a notice of withdrawal even on the last day of the 14-day period.
Upon receipt of the notice of withdrawal, the seller shall, within 14 days at the latest, refund to the buyer all payments received from the buyer under or in connection with the contract, including the costs of delivery, delivery and postage, and other costs and charges. The seller shall refund the payment using the same method as that used by the buyer for their payment. The buyer may also agree with the seller on an alternative method of refund.
The seller is not obliged to reimburse the buyer for additional costs if the buyer has expressly chosen a method of delivery other than the cheapest standard method of delivery offered by the seller. Additional costs are defined as the difference between the delivery costs chosen by the buyer and the costs of the cheapest standard delivery method offered by the seller.
In the event of withdrawal from the contract, the seller is not obliged to refund the buyer’s payment before the goods have been delivered to the buyer or until the buyer provides evidence that the goods have been returned to the seller, unless the seller proposes to collect the goods in person or through a person authorised by them.
The buyer is obliged to return the goods or hand them over to the seller, or to a person authorised by the seller to take delivery of the goods, no later than 14 days from the date of withdrawal from the contract. This time limit shall be deemed to have been met if the goods were handed over for transport no later than the last day of the time limit.
Upon withdrawal from the contract, the buyer shall bear only the costs of returning the goods to the seller or to a person authorised by the seller to take delivery of the goods, as well as the costs of returning goods which, due to their nature, cannot be returned by post.
The buyer is liable for any reduction in the value of the goods resulting from handling the goods beyond what is necessary to ascertain their characteristics and functionality.
Upon delivery of the goods, the buyer may test their functionality but may not use the goods if they are withdrawing from the contract. For the purposes of ascertaining the nature, characteristics and functionality of the goods, the consumer should handle and inspect the goods only in the manner in which they would be permitted to do so in a high-street shop. The buyer is required to handle and inspect the goods with due care during the withdrawal period. For example, the buyer should not install or use purchased flooring and should return the goods with their original tags or other protective or identifying features.
Alternative dispute resolution
The buyer – the consumer – has the right to contact the seller to request a remedy (for example, by email), if they are not satisfied with the way in which the seller has handled their complaint or if they believe that the seller has infringed their consumer rights. If the seller rejects this request or fails to respond to it within 30 days of it being sent, the consumer has the right to submit a request for alternative dispute resolution to an alternative dispute resolution body (hereinafter referred to as an ‘ADR body’) pursuant to Act No. 391/2015 Coll. ADR bodies are authorities and authorised legal entities as defined in Section 3 of Act No. 391/2015 Coll. A list of ADR bodies can be found on the website of the Ministry of Economy of the Slovak Republic at www.mhsr.sk. A consumer may submit a claim in the manner specified in Section 12 of Act No. 391/2015 Coll.
A consumer may also lodge a complaint via the RSO alternative dispute resolution platform, which is available online at https://ec.europa.eu/consumers/.
Alternative dispute resolution may only be used by a consumer – a natural person who, when concluding and performing a consumer contract, is not acting within the scope of their business, employment or profession. Alternative dispute resolution applies only to disputes between a consumer and a seller arising from or relating to a consumer contract. Alternative dispute resolution applies only to distance contracts. Alternative dispute resolution does not apply to disputes where the value of the claim does not exceed EUR 20. The ADR body may require the consumer to pay a fee of up to 5 EUR (including VAT) to initiate the alternative dispute resolution process.
